In a historic development for consumer data protection, Google has agreed to pay $1.375 billion to settle claims brought by the state of Texas regarding violations of user privacy rights. This settlement, announced on May 9, 2025, marks the largest recovery ever secured by a single state against Google for privacy law violations and signals a growing trend of accountability for tech giants.

 The Settlement Details

Texas Attorney General Ken Paxton announced the settlement in principle with Google following years of aggressive litigation. The agreement resolves two lawsuits that covered three specific areas where Google allegedly violated Texas consumer protection laws:

  1. Geolocation Tracking: Google was accused of deceptively tracking users’ physical locations without proper consent.
  2. Incognito Mode Searches: The company allegedly collected and stored private search data even when users believed they were browsing privately using Chrome’s Incognito mode.
  3. Biometric Data Collection: Google faced accusations of unauthorized capture and use of biometric data, including facial geometry and voiceprints through their products and services.

According to the Texas Attorney General’s office, this settlement far exceeds any previous recovery by a state for similar violations. For comparison, no other state has secured more than $93 million from Google for comparable data privacy claims. Even a coalition of forty states previously reached a settlement of just $391 million – nearly a billion dollars less than Texas’s recovery.

 No Product Changes Required

While the monetary value of the settlement is substantial, it’s worth noting that Google is not required to make any product changes as part of the agreement. Google spokesperson Jose Castaneda stated that the company did not admit any wrongdoing or liability in the settlement. He further clarified that all of the policy changes related to the allegations were previously announced or implemented.

“This settles a raft of old claims, many of which have already been resolved elsewhere, concerning product policies we have long since changed,” Castaneda said. “We are pleased to put them behind us, and we will continue to build robust privacy controls into our services.”

 A Pattern of Privacy Enforcement in Texas

This settlement represents the latest in a series of significant actions by Texas against major technology companies. In July 2024, Attorney General Paxton secured a $1.4 billion settlement with Meta (formerly Facebook) for unlawfully collecting and using facial recognition data – another record-breaking recovery. Prior to these cases, Texas reached settlements of $700 million and $8 million with Google for anticompetitive and deceptive trade practices.

These actions highlight Texas’s aggressive stance on holding tech companies accountable for data privacy violations and signal that states are increasingly willing to pursue significant penalties against even the largest technology corporations.
